These Terms & Conditions (“Terms”) govern the use of the City Scape Customs Clearance website and the provision of customs clearance and related services by City Scape Customs Clearance (“City Scape”, “we”, “us”, or “our”).
By requesting our services, accepting a quotation, instructing City Scape to proceed with customs clearance, making a payment, or using a payment link issued by City Scape, the customer (“Customer”, “you”, or “your”) acknowledges and agrees to these Terms.
1. Our Services
City Scape provides customs clearance and related services, which may include:
Customs declaration preparation and submission;
Customs documentation review;
HS code and customs classification assistance;
Customs duty and tax calculation support;
Government permit and approval coordination;
Customs inspection coordination;
Land-border customs clearance;
Border documentation and processing;
Shipment follow-up and coordination;
Payment of applicable customs duties, taxes, and government charges on behalf of customers where authorized;
Related logistics and support services.
The specific services provided will depend on the customer’s requirements and the applicable quotation, invoice, service order, or written instruction.
2. Customer Responsibilities
The Customer is responsible for providing complete, accurate, and genuine information and documentation required for customs clearance.
This may include:
Commercial invoices;
Packing lists;
Certificates of origin;
Import/export documents;
Permits and approvals;
Product descriptions;
HS codes or product information;
Consignee and shipper details;
Vehicle and driver information;
Customs registration information; and
Any other documents required by the relevant authority.
The Customer remains responsible for the accuracy and legality of information and documents supplied to City Scape.
3. Customs Classification and Duties
Customs duties, taxes, fees, permits, inspections, deposits, and other government charges are determined by the relevant customs or government authorities.
Any duty, tax, or government-charge amount communicated by City Scape before final customs assessment may be an estimate unless expressly confirmed as final.
The final amount may change following customs assessment, inspection, valuation, classification, documentation review, or changes imposed by the relevant authority.
Any additional amount required to complete the customs clearance must be paid by the Customer.
4. Cash Against Customs Clearance
Where City Scape provides customs clearance on a cash-advance or cash-against-clearance basis, the Customer must provide the required funds before City Scape is required to make payment or proceed with the relevant customs transaction.
City Scape may suspend or delay processing where sufficient funds have not been received.
Payment of funds to City Scape does not guarantee customs approval, cargo release, or a specific clearance time.
5. Online Payment Links
City Scape may provide customers with a secure electronic payment link issued through an approved payment gateway or financial institution.
The payment link may be used to pay:
Customs duties and taxes;
Government charges;
Customs clearance charges;
Service fees;
Documentation and handling charges; and
Other amounts specified in the applicable quotation or invoice.
The Customer is responsible for reviewing the payment amount and transaction details before completing the payment.
Once the payment is successfully authorized and confirmed, City Scape may immediately proceed with the requested customs clearance or related services.
6. Credit and Debit Card Payments
Credit and debit card payments are processed through the relevant payment service provider or payment gateway.
City Scape does not guarantee that a payment will be approved by the customer’s bank or card issuer.
The Customer must use a payment card that the Customer is authorized to use.
City Scape may request additional information or verification where reasonably necessary to prevent fraud or unauthorized transactions.
7. Payment Confirmation
A successful payment confirmation does not itself constitute customs approval or cargo release.
Payment only confirms that the applicable amount has been successfully received or authorized for processing.
Customs clearance remains subject to the requirements, decisions, inspections, approvals, systems, procedures, and operating conditions of the relevant authorities.
8. Cancellation and Refunds
Payments are generally non-refundable once the requested customs clearance or related service has commenced or City Scape has incurred or committed costs on behalf of the Customer.
This includes amounts paid or committed toward customs duties, taxes, government charges, inspections, permits, third-party services, documentation, transportation, and other related costs.
Any refund, correction, or cancellation will be handled in accordance with City Scape’s Refund & Cancellation Policy and applicable UAE law.
9. Government Authorities and Third Parties
City Scape acts as a customs clearance service provider and may communicate with customs authorities, border authorities, ports, government departments, carriers, transport companies, warehouses, payment providers, and other third parties on behalf of the Customer where authorized or required.
City Scape does not control the actions, decisions, operating hours, systems, delays, inspections, fees, or requirements of such authorities or third parties.
10. Delays and Events Outside Our Control
City Scape shall not be responsible for delays or inability to complete a service caused by circumstances outside our reasonable control, including but not limited to:
Customs system interruptions;
Government system outages;
Customs inspections;
Border closures or restrictions;
Changes in customs regulations;
Changes in government requirements;
Delays by ports, terminals, carriers, warehouses, or transport providers;
Incomplete or incorrect customer documentation;
Missing permits or approvals;
Cargo restrictions or prohibitions;
Security or regulatory requirements;
Weather or natural events;
Strikes or industrial action;
Traffic or border congestion; or
Other circumstances beyond City Scape’s reasonable control.
11. Prohibited or Restricted Goods
The Customer must inform City Scape of any goods that are prohibited, restricted, controlled, hazardous, regulated, or subject to special permits or approvals.
The Customer is responsible for ensuring that the goods comply with applicable UAE laws, customs requirements, and other applicable regulations.
City Scape may refuse to process any shipment where it reasonably believes that the shipment, documentation, transaction, or requested service may violate applicable law or regulatory requirements.
12. Customer Indemnity
The Customer shall be responsible for losses, penalties, additional costs, claims, or liabilities arising from inaccurate, incomplete, misleading, or fraudulent information or documentation provided by the Customer, or from the Customer’s failure to obtain required permits or approvals.
This clause does not exclude or limit any liability that cannot lawfully be excluded or limited under applicable UAE law.
13. Limitation of Liability
City Scape will exercise reasonable care in providing its services.
However, City Scape shall not be responsible for losses, delays, penalties, storage charges, demurrage, detention, customs decisions, inspections, government actions, or third-party charges arising from circumstances outside City Scape’s reasonable control or from information or documents supplied by the Customer.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. Invoices and Records
City Scape may issue quotations, invoices, receipts, payment confirmations, and other transaction records electronically.
The Customer should retain these documents for its records.
The Customer is responsible for reviewing invoices and notifying City Scape promptly of any apparent discrepancy.
15. Communication
The Customer authorizes City Scape to communicate regarding the requested services using the contact details provided by the Customer, including email, telephone, WhatsApp, SMS, or other agreed communication methods.
Electronic communications may be used for quotations, invoices, payment links, customs documentation, service updates, and transaction confirmations.
16. Website Use
The Customer agrees not to:
Use the website for unlawful purposes;
Attempt unauthorized access to the website or its systems;
Interfere with website security or functionality;
Submit fraudulent or misleading information; or
Use the website or payment facilities in a manner that violates applicable law.
City Scape reserves the right to restrict or terminate access to website features where misuse or unlawful activity is suspected.
17. Intellectual Property
Unless otherwise stated, the content of the City Scape website, including text, logos, graphics, designs, documents, and other materials, is owned by or licensed to City Scape and may not be reproduced, copied, distributed, or commercially used without prior written permission.
18. Privacy
Personal and business information provided to City Scape is handled in accordance with our Privacy Policy.
By using our services, the Customer acknowledges and accepts the collection and processing of information necessary to provide the requested services and comply with applicable legal and regulatory requirements.
19. Amendments
City Scape may update these Terms from time to time to reflect changes in its services, business operations, technology, or applicable legal and regulatory requirements.
The updated Terms will be published on the website and will apply to transactions entered into after the effective date of the updated Terms.
20. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the applicable laws of the United Arab Emirates and the applicable laws of the Emirate in which City Scape is licensed and operates, unless otherwise required by applicable law.
Any dispute arising from or relating to these Terms or the services provided by City Scape shall be subject to the jurisdiction of the competent courts of the United Arab Emirates, subject to any mandatory legal requirements applicable to the dispute.
21. Customer Acceptance
By requesting services, accepting a quotation, instructing City Scape to proceed, using our website, or completing a payment through a City Scape payment link, the Customer confirms that the Customer has read, understood, and accepted these Terms & Conditions and the applicable Privacy Policy and Refund & Cancellation Policy.
